1. * Choose File→Open.
2. * Navigate to the **book** folder and select the `final_chapter_01.psd` file you used in the exercise.

Photoshop opens the file and begins to load it into its work area.

3. * If the **Clone Stamp tool** is visible, click on it with your mouse. A small square appears in the drawing area. If it is not visible, choose Window→Stamps. In the Stamps panel of the Workspace, click on the + symbol. A new square appears in the drawing area. This square is the cloning tool. You can also get to the Stamp panel by choosing Window→Stamps.
4. * Click on the grid inside the cloning tool to put the tool on a grid. This gives you a precise overview of where it will be moved, as shown here.
5. * Click once to put the tool onto the canvas with a single click. It appears as a blue box. Now you can position the box wherever you like on the canvas, click once, and it’s all set. Click once again to activate the move tool, and begin moving the clone tool around the canvas.

# Post-work editing

You can now save the file by choosing File→Save and, using the File Format dialog box that appears, change the file type to Photoshop file format.psd.

The Save As dialog box will allow you to change the name and location of the file. Choose a name, press Enter, and Photoshop will create the file.

The trial record does not present even a scintilla of evidence, direct or circumstantial, which, if believed by the jury, would warrant a conviction of involuntary manslaughter.

Instruction F-3 was derived from Williams v. Jones, 452 F.2d 967 (5th Cir.1971) (per curiam) and is quoted in the majority opinion. The instruction is quite proper as applied to a police officer’s use of unprofessional and excessive force in arresting a person.

What constitutes “excessive force” under circumstances like those in the instant case is a subject of legitimate controversy. When the officer is a black policeman beating a suspect in his own apartment, I assume that some higher courts would require a more stringent standard of proof than in the instant case, where the victim is white, drunk and belligerent, probably the aggressor, and the police are acting in furtherance of their duties.

The record here indicates only that McCurdy’s hand was pushed away and some blows (or “pushes”) were administered. There is no evidence of any abusive language or of McCurdy’s response to the officer’s assertion that he was under arrest. Had there been any mention by the officer of a “punch-out-man” instruction, or words to that effect, I would have been inclined to find that use of an excessive force instruction was warranted under the circumstances of this case.
